2. Acceptance of Terms

By downloading, installing, or using TCGrail ("the app"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

3. Description of Service

TCGrail is a mobile application for managing Trading Card Game collections. Features include card scanning via AI, price tracking, collection management, trading, and AI-powered card grading.

4. User Accounts

You must create an account to use the app
You are responsible for maintaining the security of your account
You must provide accurate information during registration
One account per person
You must be at least 16 years old to create an account

5. Subscription Plans and Pricing

Free Plan

Includes unlimited card scanning (with advertisements), collection management, price history, and trending data.

TCGrail Plus (3.99 EUR/month or 29.99 EUR/year)

Ad-free experience, unlimited scans, up to 10 price alerts.

TCGrail Pro (7.99 EUR/month or 59.99 EUR/year)

All Plus features plus unlimited AI Grading, unlimited price alerts, and data export.

TCGrail Lifetime (179.99 EUR one-time)

All Pro features permanently.

All prices include applicable VAT. Prices may vary by region based on Google Play pricing.

Billing and Renewal

Subscriptions are billed through Google Play
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
You can manage and cancel subscriptions in Google Play Store → Subscriptions
No partial refunds are given for unused subscription periods upon cancellation

6. Right of Withdrawal (EU Consumer Rights)

As an EU consumer, you have the right to withdraw from a purchase within 14 days without giving any reason, in accordance with EU Directive 2011/83/EU.

For Subscriptions:

You may cancel your subscription within 14 days of purchase for a full refund via Google Play. After 14 days, you may cancel at any time but the subscription will remain active until the end of the current billing period.

For Lifetime Purchase:

You may request a refund within 14 days of purchase via Google Play's refund policy. After 14 days, the purchase is final.

Exception:

By using digital content immediately after purchase, you acknowledge that you may lose your right of withdrawal once the content has been fully delivered and the service has been accessed, in accordance with Art. 16(m) of EU Directive 2011/83/EU. You will be informed of this before confirming your purchase.

7. Acceptable Use

You agree not to:

Use the app for any illegal purpose
Attempt to reverse engineer or decompile the app
Abuse the API or automated scanning features
Create fake accounts or impersonate others
Upload harmful, offensive, or inappropriate content
Attempt to bypass subscription restrictions or ad mechanisms

8. Card Pricing Disclaimer

Important: Card prices displayed in the app are sourced from third-party marketplaces (CardMarket) and are for informational purposes only. Prices may not reflect actual market value at the time of a transaction. TCGrail is not responsible for any financial decisions made based on pricing data shown in the app.

9. AI Grading Disclaimer

AI-powered card grading is an automated estimate and should not be considered equivalent to professional grading services (PSA, BGS, CGC). AI grades are approximate and for personal reference only. No guarantee of accuracy is provided.

10. Intellectual Property

TCGrail and its original content are owned by Endemine OÜ
Trading card images and names are the property of their respective owners (The Pokemon Company, Wizards of the Coast, Konami, Bandai, etc.)
TCGrail is not affiliated with or endorsed by any TCG publisher

11. Limitation of Liability

To the extent permitted by applicable law, TCGrail is provided "as is" without warranties of any kind. We are not liable for:

Data loss (though we make reasonable efforts to prevent it)
Inaccurate pricing data from third-party sources
Inaccurate AI grading results
Service interruptions or downtime
Losses resulting from trades facilitated through the app

This limitation does not apply to damages caused by intentional misconduct or gross negligence, or to any mandatory liability under applicable law.

12. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through the app settings. Upon deletion, all your personal data will be permanently removed in accordance with our Privacy Policy.

Retention of anonymized billing records: Notwithstanding the above, anonymized billing and transaction records (such as subscription purchase history and Google Play order IDs) are retained for 7 years after account deletion, as required by the Estonian Accounting Act (Raamatupidamise seadus §12). All personal data (name, email) is removed from these records upon deletion — only anonymized transaction data is kept to satisfy the legal accounting obligation. After 7 years, all remaining records are permanently deleted.

13. Online Dispute Resolution

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law.

14. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via in-app notification. Continued use of the app after changes constitutes acceptance of the new terms. If you do not agree to the new terms, you may stop using the app and delete your account.

15. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Estonia. For consumers in the EU, mandatory consumer protection laws of your country of residence also apply to the extent they provide more protection.

Any disputes shall be resolved in the courts of Tallinn, Estonia, unless mandatory EU consumer law requires otherwise (in which case you may bring proceedings in your country of residence).

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
